Consent

Definition

Consent definition - CALACS de L'EST BSLSexual consent is the agreement given to one’s partner during sexual activity (kissing, touching, sexual acts). Sexual consent must be given in a free, informed and enthusiastic manner. The situation must be such that the withdrawal of consent is possible at any time.

It can be expressed verbally or non-verbally. If the person does not say anything, or is not able to refuse, there is no consent. In addition, kissing or fondling a person does not mean that he or she consents to other sexual acts. It must be renewed with each sexual act.

If a person refuses to participate in sexual activity with another person and is forced to do so, this is sexual assault. No one has the right to force sex on another person against their will.

Withdrawal of consent

If a person decides that she does not want to continue the sexual activity, she can withdraw consent at any time.

A person can give consent to sexual activity and then change their mind once the activity has begun.

Once a person expresses refusal through words or actions, the partner must stop the sexual activity immediately. If the partner continues despite the expressed refusal, he is committing sexual assault.

Age of sexual consent

The legal age of consent for sexual activity is 16.

However, a person who is 12 or 13 years old can consent to sexual activity if their partner is less than two years older, which is 13 or 14 years old. A person who is 14 or 15 years old can consent to sexual activity as long as their partner is less than five years older, which is 18 or 19 years old.

In all cases, sexual consent is not valid if there is voluntary or involuntary intoxication by drugs, alcohol, medication that affects decision-making and/or functional capacities, if there is the presence of threats or violence, or if there is a situation of authority, dependence, exploitation or abuse of trust. The three criteria for consent are that it must be informed, given freely and with enthusiasm.

To freeze is not to consent
